Gjykata Nd\u00ebrkomb\u00ebtare e Drejt\u00ebsis\u00eb (GJND) vendosi se territoret e pushtuara palestineze p\u00ebrb\u00ebjn\u00eb nj\u00eb \u201cunitet t\u00eb vet\u00ebm territorial\u201d, i cili do t\u00eb mbrohet dhe respektohet.<\/p>\n\n\n\n

Duke theksuar se rregulloret e Hag\u00ebs jan\u00eb b\u00ebr\u00eb pjes\u00eb e s\u00eb drejt\u00ebs zakonore nd\u00ebrkomb\u00ebtare, dhe si rrjedhim jan\u00eb t\u00eb detyrueshme p\u00ebr Izraelin, gjykata tha: “Mbrojtja e ofruar nga Konventa e t\u00eb Drejtave t\u00eb Njeriut nuk pushon n\u00eb rast konflikti t\u00eb armatosur ose okupimit”.<\/p>\n\n\n\n

N\u00eb lidhje me pushtimin e territoreve palestineze nga Izraeli, gjykata vuri n\u00eb dukje se “shfryt\u00ebzimi i burimeve natyrore” nga Izraeli n\u00eb territorin e pushtuar palestinez \u00ebsht\u00eb “n\u00eb kund\u00ebrshtim me detyrimin e tij” p\u00ebr t\u00eb respektuar t\u00eb drejt\u00ebn e palestinez\u00ebve p\u00ebr sovranitet.<\/p>\n\n\n\n

M\u00eb ve\u00e7an\u00ebrisht n\u00eb lidhje me d\u00ebbimet me forc\u00eb n\u00eb Kudsin Lindor dhe Bregun Per\u00ebndimor, gjykata theksoi se politikat dhe praktikat e Izraelit shkelin ndales\u00ebn e Konvent\u00ebs s\u00eb 4-t\u00eb t\u00eb Gjenev\u00ebs p\u00ebr transferimin me forc\u00eb t\u00eb popullsive t\u00eb mbrojtura.<\/p>\n\n\n\n

\u201cPolitika e vendbanimeve e Izraelit \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me Konvent\u00ebn e 4-t\u00eb t\u00eb Gjenev\u00ebs,\u201d tha GJND.<\/p>\n\n\n\n

Gjykata tha se politikat dhe praktikat e Izraelit p\u00ebrb\u00ebjn\u00eb aneksimin e pjes\u00ebve t\u00eb m\u00ebdha t\u00eb territorit t\u00eb pushtuar palestinez dhe se ajo “nuk \u00ebsht\u00eb e bindur” se shtrirja e ligjit izraelit n\u00eb Bregun Per\u00ebndimor dhe Kudsin Lindor \u00ebsht\u00eb i justifikuar.<\/p>\n\n\n\n

GJND gjithashtu pohoi se Izraeli ka qen\u00eb n\u00eb gjendje t\u00eb ushtroj\u00eb autoritet ky\u00e7 mbi Rripin e Gaz\u00ebs pavar\u00ebsisht t\u00ebrheqjes s\u00eb pranis\u00eb s\u00eb tij ushtarake n\u00eb 2005.<\/p>\n\n\n\n

Gjithashtu, GJND vler\u00ebson se Izraeli ka detyrim t’i jap\u00eb fund pranis\u00eb s\u00eb tij n\u00eb territorin e pushtuar palestinez \u201csa m\u00eb shpejt t\u00eb jet\u00eb e mundur\u201d.<\/p>\n\n\n\n

GJND thot\u00eb se t\u00eb gjitha shtetet jan\u00eb t\u00eb detyruara t\u00eb mos njohin si ligjore situat\u00ebn q\u00eb rrjedh nga \u201cprania e paligjshme\u201d e Izraelit n\u00eb territorin e pushtuar palestinez.<\/p>\n\n\n\n

GJND konsideron se e drejta e palestinez\u00ebve p\u00ebr t\u00eb pasur ‘shtet t\u00eb pavarur dhe sovran’, q\u00eb jeton krah p\u00ebr krah n\u00eb paqe me Izraelin, do t\u00eb kontribuonte n\u00eb stabilitetin rajonal.<\/p>\n","protected":false},"excerpt":{"rendered":"
